1. Acceptance of Terms
By installing and using PacForm - US EPR & CAA Reports ("the App"), provided by Merchard, LLC ("we," "us," or "our"), you agree to these Terms of Service. The App is provided strictly as a B2B service for Shopify merchants.
2. Description of Service
PacForm provides tools to help merchants calculate and configure packaging weights for U.S. Extended Producer Responsibility (EPR) and the Corporate Transparency Act / Clean Air Act (CAA) compliance. The Free Tier allows manual configuration, and the Premium Tier ($49/year) unlocks automated CSV export functionality.
3. Billing and Subscriptions
All payments for the Premium Tier are processed directly through Shopify's unified billing system. By upgrading, you agree to Shopify's billing terms. You may cancel your subscription at any time by uninstalling the app or managing your subscription within the Shopify Admin.
4. No Legal or Compliance Guarantee
PacForm is a software tool designed solely to assist with packaging weight calculations and data formatting. Merchard, LLC is not a legal, accounting, or compliance firm. While we strive for accuracy in our calculations and exports, the ultimate responsibility for verifying data and ensuring full compliance with U.S. EPR, CAA, or any other state/federal regulations rests solely with the merchant. Merchard, LLC is not liable for any fines, penalties, audits, or compliance failures incurred by your business.
5. Limitation of Liability
To the maximum extent permitted by law, Merchard, LLC shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the App, including but not limited to data loss, compliance penalties, or business interruption.
6. Termination
You may terminate this agreement at any time by uninstalling the App from your Shopify store. We reserve the right to terminate or suspend access to the App for any violation of these terms or Shopify's Acceptable Use Policy.

1. Information We Collect
When you install PacForm - US EPR & CAA Reports, operated by Merchard, LLC ("we," "us," or "our"), we automatically access certain types of information from your Shopify account:
Shop Information: Your store domain, email address, and localization settings.
Product Information: We access product and variant data (such as existing weights and SKUs) necessary to calculate and configure packaging weights for U.S. EPR & CAA compliance.
Customer Information: PacForm does not collect, store, or process personal identifiable information (PII) of your end customers. Our operations are strictly limited to product and packaging data.
2. How We Use Your Information
We use the collected information solely to provide and improve the PacForm service. This includes calculating packaging weights, enabling the Free Tier configuration UI, and processing CSV exports for Premium users.
3. Data Retention and Deletion
We retain your shop and product configuration data as long as the app is installed. If you uninstall PacForm from your Shopify admin, we will receive a webhook from Shopify and automatically purge your data from our systems within 30 days, in strict accordance with Shopify's data protection requirements.
4. Third-Party Services
Your data is processed securely via our hosting provider (Render). All billing and payment processing is handled natively by Shopify. We do not sell, rent, or share your data with third parties.

17. TerminationYou may stop using the Services at any time. You may also uninstall software, cancel subscriptions, close accounts, disconnect integrations, or terminate platform access through the applicable Service or third-party platform.Merchard may suspend, restrict, or terminate access to any Service if we believe you have violated these Terms, created risk, failed to pay required fees, misused the Services, violated platform rules, or used the Services unlawfully.Provisions relating to user responsibility, disclaimers, limitation of liability, indemnification, intellectual property, and governing law survive termination.18.
